I hereby assume all of the risks of participating in L4 Lacrosse, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of their possible liability without fault. I certify that I am physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in L4 Lacrosse. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of L4 Lacrosse in which I may participate and that it will govern my actions and responsibilities in said activities. In consideration of my application and permitting me to participate in L4 Lacrosse, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from L4 Lacrosse events. THE FOLLOWING ENTITIES OR PERSONS: L4 Lacrosse, Reid Wesley, Dylan Gatt, King Louie's Sports Complex, and/or their coaches, agents, representatives or volunteers.
(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in L4 Lacrosse, whether caused by negligence or otherwise.
I acknowledge that lacrosse and any related training may carry with it the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and lack of hydration.
I consent and agree that L4 Lacrosse, LLC, and/or their coaches, agents, representatives, or volunteers may take photographs or digital recordings of me as a participant during events and use these in any and all media for training or promotional purposes. I further consent that my identity may be revealed therein or by description text or commentary. I waive any rights, claims or interest and I understand that there will be no financial or other remuneration.
The accident waiver, release of liability and image release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT ON MY OWN FREE WILL.
PARENT/GUARDIAN WAIVER FOR MINORS (under 18 years old) The Undersigned parent and or natural guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in L4 Lacrosse and has agreed individually and on behalf of the child or ward, to the terms of the accident waiver and release of liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect on lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
Facility Waiver and COVID-19 Waiver Liability
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact, including individuals without disease symptoms. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited or limited the congregation of groups of people. The health and well-being of our staff, coaches, trainers, and athletes remain our top priority. In order to minimize the risk of COVID-19 entering our environment and spreading amongst our community, King Louie’s Sports Complex and L4 Lacrosse will only allow staff assigned to work and athletes, trainers and coaches scheduled to participate to be in our facility. Athletes waiting to attend a session will need to wait in the parking lot in their car/Parent’s car while maintaining social distance from others. Furthermore, all participants in approved activities at King Louie’s Sports Complex must agree to and abide by the following: 1. Limited Parent/Spectator Participation During Indoor Activities – Only 2 parents/spectators will be allowed to stay at the facility while Team practices/program/tournaments activities are being conducted for all indoor activities. Please do not arrive for activities any earlier than 15 minutes prior to your scheduled start time. This may change as conditions warrant. As of now, there are NO restrictions on the number of parents/spectators for OUTDOOR activities, but all spectators will be required to wear a mask and practice social distancing 2. Masks – KL and L4 Lacrosse requires all parents and non-athlete attendees to wear them. Players/participants will not be required to wear them while participating in their activities 3. Player Equipment – all bags/equipment for each player/participant will need to be spaced along the sidelines. 4. Social Distancing – Teams/programs are responsible for maintaining/enforcing social distancing for their players and coaches during their practices/programs/tournament. KL and L4 Lacrosse is not responsible for enforcement 5. Field Spacing – Teams will need to make sure that groups sharing any outdoor/indoor field remain spaced and stay on their side of the field unless competing against one another 6. Bathrooms – only 2 people at a time will be allowed in public bathrooms 7. Concession Stand – will be open at times, but there will be no seating in common area and markers will be on floors to insure social distancing. Staff will be wearing appropriate PPE 8. Hand Sanitizing – KL will provide a hand sanitizer, but players/coaches are encouraged to bring their own hand sanitizer and towels as well 9. Stay at Home Mandate – anyone not feeling well, or exhibiting any symptoms will be required to stay at home. Anyone who is considered “at-risk” with any pre-existing conditions making them more vulnerable to the virus should not attend any activities at KL King Louie’s Sports Complex (hereafter referred to as the “KL”) has put in place numerous preventative measures and enhanced cleaning protocols to reduce the likelihood of spreading COVID-19 in KL’s facility environment; however, KL cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending sponsored activities at KL could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this waiver and agreement, I acknowledge the contagious nature of COVID-19 and voluntarily agree to the participation terms described above and assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending KL or The L4 Louisville Box Classic and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at KL may result from the actions, omissions, or negligence of myself and others, including, but not limited to, KL employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at KL or participation in KL programming (“Claims”).
On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless KL, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.
I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of KL, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any KL and Louisville Box Classic activity.
